Understanding Guardianships and Conservatorships

What is Guardianship?

Guardianship is when a judge gives one person the legal authority to make personal and medical decisions for another person who cannot do so safely on their own. In Oregon, guardianships are used to help protect children or vulnerable adults. The court’s goal is to support the person’s safety, health, and well-being while using the least restrictive option possible.

What is Conservatorship?

A conservator is a fiduciary appointed by the court to protect and manage the assets of an incapacitated adult or a minor child. Their role is to ensure that financial resources are safeguarded and used responsibly for the benefit of the protected person.
